Wednesday, September 5, 2012

Advisory Neighborhood Commission 2C convened at the Watha T. Daniel/Shaw
Neighborhood Library, 1630 7th Street, NW, Washington, DC, on Wednesday,
September 5, 2012 at 6:30 p.m. Chair Alexander M. Padro presided.

I. CALL TO ORDER AND ROLL CALL
Commissioner Padro called the meeting to order at 6:35 p.m. Commissioner
Nigro called the roll and the presence of a quorum was noted.

II. APPROVAL OF AGENDA
MOTION: Commissioner Nigro moved and Commissioner Chapple seconded
that the Agenda be approved as submitted. The Motion passed unanimously, 4
– 0 – 0.

III. PSA 308 REPORT: METROPOLITAN POLICE DEPARTMENT
Lt. Linda Wingate of Police Service Area 308 reported on criminal activity in the
area for the period August 1-31, 2012 as follows:
Robberies 3
Burglaries 2
Thefts from Vehicles 17
Thefts 23
Stolen Autos 2
Assaults with Dangerous Weapons 2
Disorderly Conduct 6
Drug-related Arrests 2
Unlawful Entry 1
Homicide 1
Lt. Wingate reported that the Summer Crime Initiative ended August 31, 2012 at
midnight. PSA 308 did extremely well, with a major decrease in violent crimes.

IV. 451 S STREET, NW: REQUEST FOR SUPPORT FOR ZONING RELIEF TO
ALLOW CONSTRUCTION OF NEW TWO-UNIT FLAT (GEORGE SIMPSON)
Leila Batties of the law firm of Holland & Knight LLP spoke in regard to the
request for support for zoning relief by George Simpson to allow construction of a
new two-unit flat at 451 S Street, NW. She advised that the application will be
filed with the BZA on October 2, 2012 and will seek two (2) variances: (1) lot
coverage variance (the lot is very narrow, but also very deep); and (2) parking
requirements (the applicant will close the existing curb cut and will generate a
new on-street parking space).
MOTION: Commissioner Chapple moved and Commissioner Nigro seconded
that ANC 2C support the application for zoning relief for 451 S Street, NW,
owned by 5th & S Street, LLC, and that said support be communicated in writing
to the Board of Zoning Adjustment (BZA). The Motion passed unanimously, 4 –
0 – 0.

V. 1131 5TH STREET, NW: REQUEST FOR SUPPORT FOR ZONING RELIEF
FOR CONTINUED OCCUPANCY OF TWO RESIDENCES ON ALLEY LOTS
AT REAR OF PROPERTY (ERIN MURPHY AND JOHANNAH SEARS)
Leila Batties of Holland & Knight, LLP, provided an update regarding the request
for support for zoning relief for continued occupancy of two residences on alley
lots at the rear of 1131 5th Street, NW, by owners Erin Murphy and Johannah
Sears. She reported that the application has been amended to include a third
property owner.
MOTION: Commissioner Nigro moved and Commissioner Padro seconded that
ANC 2C support the addition of the third property owner to the application and
that support of said application, as amended, be communicated in writing to the
Board of Zoning Adjustment (BZA). The Motion passed, 3 yeas – 0 nays – 1
abstention (Commissioner Brooks).

VI. 901 G STREET, NW: CONSIDERATION OF RESOLUTION IN SUPPORT OF
CONTINUED USE OR SHARED USE OF MARTIN LUTHER KING, JR.
MEMORIAL LIBRARY
Commissioner Padro spoke regarding a proposal developed by the Urban Land
Institute for continued use or shared use of the Martin Luther King, Jr. Memorial
Library. He stated that there are two potential options for continued library use:
(1) renovate the building and reconfigure the upper floors of the building as
commercial office space, and potentially add a fifth story; and (2) renovate the
building for continued exclusive occupancy by the library. He advised that there
will be a meeting later in September where input will be received from the public.
He noted that the Library Board supports mixed use of the building.

MOTION: Commissioner Padro moved and Commissioner Brooks seconded
that ANC 2C advise the DC Library Board of Trustees, the DC Council, and
Mayor Gray that the community supports the proposed modification of the use of
the Martin Luther King, Jr. Memorial Library building to include commercial use in
order that funds may be raised to renovate and maintain the library. The Motion
passed unanimously, 4 – 0 – 0.
VII. 645 NEW YORK AVENUE, NW: APPROVAL OF REVISED VOLUNTARY
AGREEMENT (NEW YORK AVENUE BEACH BAR)
Commissioner Padro reported that this past Spring the Commission had
approved the voluntary agreement. However, the ABC Board requested a
modification.
MOTION: Commissioner Padro moved and Commissioner Chapple seconded
that ANC 2C agree to the modification of the voluntary agreement for the New
York Avenue Beach Bar at 645 New York Avenue, NW, to meet the requirements
of the ABC Board. The Motion passed unanimously, 4 – 0 – 0.

VIII. 1608 7TH STREET, NW: REQUEST FOR SUPPORT FOR SUBSTANTIAL
CHANGE TO ABC LICENSE (UPTOWN ETHIOPIAN FUSION CUISINE)
Gebremiskal Kahassai spoke regarding the request for support from Uptown
Ethiopian Fusion Cuisine, formerly Fasil Ethiopian Restaurant, for a substantial
change to its ABC license. The restaurant would like to add the second floor of
the building at 1608 7th Street, NW for use as additional restaurant space.
MOTION: Commissioner Padro moved and Commissioner Nigro seconded that
ANC 2C support the substantial change to the ABC license of Uptown Ethiopian
Fusion Cuisine at 1608 7th Street, NW, and that said support be communicated in
writing to the ABC Board. The Motion passed unanimously, 4 – 0 – 0.
Mr. Kahassai invited members of the community to attend free of charge the
restaurant’s Grand Opening, to take place on September 6, 2012 from 6:00 p.m.
to 10:00 p.m.

IX. 1017 7TH STREET, NW: REQUEST FOR SUPPORT FOR STIPULATED AND
PERMANENT ABC LICENSES FOR NEW RESTAURANT (NAME TBD)
Angie Salame stated that the Ruppert’s Real Restaurant, LLC team has been
developing a new restaurant incubator at 1017 7th Street, NW, where new
restaurant concepts with different chefs would operate in the space for
approximately six months at a time. Ruppert’s requested support for stipulated
and permanent ABC licenses for the as yet unnamed new restaurant incubator at
1017 7th Street, NW.

MOTION: Commissioner Padro moved and Commissioner Nigro seconded that

ANC 2C support the request for a stipulated and permanent ABC license (Class
CR) for the Ruppert’s Real Restaurant, LLC’s as yet unnamed new restaurant at
1017 7th Street, NW and that said support be communicated in writing to the ABC
Board. The Motion passed, 3 yeas – 1 nay (Commissioner Brooks) – 0
abstentions.

X. 675 H STREET, NW: REQUEST FOR SUPPORT FOR STIPULATED AND
PERMANENT ABC LICENSES FOR NEW RESTAURANT (YO! SUSHI)
David Briggs of the law firm of Holland & Knight, LLP spoke regarding the
request for support for stipulated and permanent ABC licenses (Class CR) for
Yo! Sushi, a new restaurant located at 675 H Street, NW. The restaurant will
have seating for 45 and be open seven (7) days a week from 11:00 a.m. to 1:00
a.m. The restaurant will serve beer, wine, and sake.
MOTION: Commissioner Padro moved and Commissioner Chapple seconded
that ANC 2C support the request for stipulated and permanent ABC licenses
(Class CR) for Yo! Sushi at 675 H Street, NW, and that said support be
communicated in writing to the ABC Board. The Motion passed, unanimously 4
– 0 – 0.

XI. HOWARD THEATRE AREA RESIDENTIAL PARKING: STATUS OF
IMPLEMENTATION OF RESIDENTIAL PERMIT PARKING AND OTHER
PROTECTIONS FOR PARKING FOR RESIDENTS NORTH OF P STREET, NW
Commissioner Padro provided an update on the status of implementation of
Howard Theatre area residential permit parking and other protections for parking
for residents north of P Street, NW. He stated that DDOT is in the process of
installing the remaining signs to offer protection for residents to park on their
residential parking blocks. Padro recognized Shaw resident Gretchen Wharton,
who is also a mayoral appointee to the DC Commission on the Arts and
Humanities, for her efforts in helping to coordinate quality control checks of the
installed signage with DDOT personnel. He anticipated that by the end of
October, all signage will be in place north of P Street, west of New Jersey
Avenue, and east of 11th Street, and south of S Street and Florida Avenue. The
Chair stated the Commission is grateful for the continued support of DDOT. He
also stated that all residents should have received visitor parking placards by
now.

XII. THANKSGIVING DAY TROT FOR HUNGER, NOVEMBER 22, 2012:
REQUEST FOR SUPPORT FOR STREET CLOSURES TO CONDUCT
FOOTRACE (SO OTHERS MIGHT EAT)
Ellen Hatherill spoke regarding the request for support by So Others Might Eat
for street closures to conduct the Thanksgiving Day Trot for Hunger on
November 22, 2012. Jo-Ann Neuhaus of the Penn Quarter Neighborhood
Association suggested that set up be done the night before in order to alleviate
noise concerns with setups in the early morning. Ms. Hatherill responded that
every consideration will be made to alleviate noise.

MOTION: Commissioner Padro moved and Commissioner Brooks seconded
that ANC 2C support the street closures required to conduct the Thanksgiving
Day Trot for Hunger on November 22, 2012 sponsored by So Others Might Eat
and that said support be communicated in writing to the Mayor’s Special Events
Task Group and to the DC Homeland Security and Emergency Management
Agency. The Motion passed unanimously, 4 – 0 – 0.

XIII. OTHER NEW BUSINESS
1st Annual Living Social Glow Run 5K, November 3, 2012: Request for
Support for Street Closures to Conduct Footrace
A representative of Living Social spoke regarding the request for support for
street closures to conduct the 1st Annual Living Social Glow Run 5K on Saturday,
November 3, 2012, at 7:00 p.m. Living Social will be using previously erected
tenting for the 2012 National Race to End Women’s Cancer to be conducted on
Sunday, November 4, 2012. Living Social will only require a signage change-out
and trash cleanup.
MOTION: Commissioner Padro moved and Commissioner Chapple seconded
that ANC 2C support the street closures required to conduct the 1st Annual Living
Social Glow Run 5K on November 3, 2012 and that said support be
communicated in writing to the Mayor’s Special Events Task Group and the DC
Homeland Security and Emergency Management Agency. The Motion passed
unanimously, 4 – 0 – 0.

XIV. OLD BUSINESS
Streetscape Improvements to 1700 Block of 6th Street, NW and 400-500
Blocks of S Street, NW:
Gretchen Wharton spoke regarding the addition of streetscapes to the 1700
block of 6th Street, NW, between Rhode Island Avenue & S Street, 400-500 block
of S Street, NW, and the intersection of 6th & S Streets, NW, and that a formal
traffic study be conducted by DDOT. These blocks have no street trees and very
narrow sidewalks. In addition, more yard space is needed.
MOTION: Commissioner Padro moved and Commissioner Chapple seconded
that ANC 2C advise DDOT, the Gray Administration, and the DC Council of the
Commission’s support for streetscape restoration on the 1700 block of 6th Street,
NW, between Rhode Island Avenue & S Street, 400-500 blocks of S Street, NW,
and the intersection of 6th & S Streets, NW, and that DDOT conduct a formal
traffic study and the necessary studies and costs of constructing these changes
so that these modifications can move forward. The Motion passed
unanimously, 4 – 0 – 0.

XV. APPROVAL OF MINUTES OF 07/11/12 MEETING
MOTION: Commissioner Nigro moved and Commissioner Padro seconded that
the Minutes of the ANC 2C Public Meeting of July 11, 2012 be approved with
corrections to be submitted to the Secretary. The Motion passed unanimously, 4
– 0 – 0.
XVI. APPROVAL OF TREASURER’S REPORT
Commissioner Chapple inadvertently did not bring the bank statement to the
meeting, so was unable to provide the balance in the checking account. He did,
however, advise that the third Quarterly Report for FY 2012 has been accepted
and ANC 2C will be receiving its quarterly allocation.
XVII. APPROVAL OF EXPENSES
MOTION: Commissioner Chapple moved and Commissioner Padro seconded
that the invoice submitted by Karen L. Loveridge in the amount of $125.00 for
Minutes of the September 5, 2012 ANC 2C Public Meeting be approved. The
Motion passed unanimously 4 – 0 – 0.

XVIII. ANNOUNCEMENTS
A. Lincoln Temple United Church of Christ is sponsoring a Community Yard and
Craft Sale to be held at 1701 11th Street, NW, on Saturday, September 8, 2012,
from 9:00 a.m. to 2:00 p.m. For further information, go to www.lincolntemple.org.
B. Shaw Main Streets will host a Community Call Box Clean-up Day for historic
police and fire call boxes throughout the Shaw neighborhood on Sunday,
September 9, 2012. Volunteers will meet in the Carter G. Woodson Memorial
Park at 9th Street and Rhode Island Avenue, NW, at 2:00 p.m.
C. Starting on Tuesday, September 11, 2012, the Shaw Community Ministry is
offering classes in digital media literacy training to adults and seniors on
Tuesdays and Thursday evenings from 6:00 p.m. to 8:15 p.m. To register, call
202-232-1258.
D. Ward 6 Councilmember Tommy Wells has extended an invitation to Ward 6
Seniors to be his guests at Ward 6 Day at Nationals Park on Monday, September
24, 2012, with a pre-game picnic at 7th & Water Streets, NW from 10:00 a.m. to
Noon, followed by the Washington Nationals vs. Milwaukee Brewers baseball
game at 1:05 p.m.
E. Parcel 42 Update: Commissioner Padro advised that seven (7) proposals
have been received by the Deputy Mayor’s Office. The Deputy Mayor’s Office
will be requesting additional information from respondents. The Deputy Mayor
will host a community meeting in October for the bidders to make presentations
to the community.

XIX. ADJOURNMENT
MOTION: There being no further business to come before the Commission,
Commissioner Chapple moved and Commissioner Nigro seconded that the
meeting be adjourned. The Motion passed unanimously, 4 – 0 – 0. The meeting
adjourned at 8:25 p.m.
